1Acceptance of Terms

1.1By using the Services you represent that you are at least the minimum age required to form a binding contract in your jurisdiction or have the permission of a parent or guardian.

1.2These Terms include any policies referenced herein (e.g., Privacy Policy, Refund Policy). We may update the Terms; updated Terms become effective when posted. Continued use after posting constitutes acceptance.

2Accounts & Security

2.1Some Services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.

2.2You agree to notify Noctyx immediately of any unauthorized use or security breach. Noctyx is not liable for losses resulting from unauthorized account use where you failed to protect credentials.

3Products, License & Use

3.1Noctyx sells digital software and related files ("Software"). Subject to payment and compliance with these Terms, Noctyx grants you a limited, non-exclusive, non-transferable license to download and use the Software in object (not source) form for your personal use only, unless a separate commercial license is purchased.

3.2You may not copy, modify, sublicense, redistribute, sell, rent, or otherwise exploit the Software except as expressly permitted by Noctyx.

3.3You acknowledge that use of certain Software may violate third-party terms of service (including game publishers' EULAs) and may expose you to account suspension, bans, or other penalties. You assume all such risks. Noctyx does not guarantee that Software will avoid detection or prevent sanctions by third parties.

4Prohibited Conduct

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe any third-party rights (intellectual property, privacy, publicity)
• Distribute malware, spyware, or otherwise harmful code
• Interfere with, reverse engineer, tamper with, or bypass security or anti-cheat systems
• Defraud, harass, or harm others

5User Content

5.1"User Content" means text, images, code, or other material you submit while using the Services. You retain ownership of your User Content.

5.2By submitting User Content you grant Noctyx a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish and display that content as necessary to provide the Services.

5.3You represent that your User Content does not violate any laws or third-party rights.

6Payments & Refunds

6.1Prices, payment methods, and billing terms are displayed at checkout. You must provide accurate payment details.

6.2Digital Goods — unless required by law or as otherwise stated in our Refund Policy, digital purchases are generally non-refundable once delivered.

6.3Noctyx reserves the right to refuse or cancel orders for any reason, including suspected fraud.

7Termination

7.1Noctyx may suspend or terminate your access for any reason, including breach of these Terms, suspected fraud, or abuse, with or without notice.

7.2Upon termination, your license to use the Software ends and you must cease all use and delete copies as directed.
